The Small Companies Administrative Rescue Process (SCARP) scheme was introduced in Ireland in 2021 to help companies that are viable yet insolvent. It was developed for small and micro companies and is part of a wider range of corporate rescue schemes examined in detail in this new book. Corporate Restructuring in Ireland deals with all of the schemes available to insolvent companies under Part 9 of the Companies Act 2014 in a comprehensive and practical manner. It deals with all relevant legislation and case law, including: Re Antigen Holdings; Re SIAC Construction Ltd; Re Traffic Group; Re Mallinckrodt; and Re Nordic Aviation Capital DAC. Part 4 of the book deals with cross-border mergers, which have taken on new significance since Brexit. This title will be included in Bloomsbury's Irish Company and Commercial Law online service.
Cian McGoldrick is a practising barrister. He has presented seminars on the new SCARP procedures and is a member of the Committee of the Corporate and Insolvency Bar Association.
